I wouldn't worry about it too much. The only one of your points above that might affect you is seeing the one tail light all the time.

Only difference between the Kawi pipe and the pipe on the BMW is the color. One is Black (Kawi) and the other is Crome (BMW). Same size. Same design and almost the same end cap. Maybe that's the way they have to be built, or maybe the Japanese just copied another part off someone elses bike...
