Great! Thanks for bringin up my business again for all to see.

No, it's all cool guys and the word "pissed" came off a little stronger than intended. And we're cool Skoot! Like you said, water under the bridge.

OK, big FJR group hug.

Skooter's Skool Of Sensitivity: Pissing Off Newbies 101 :D

I just miss the good ole days when Skoot would just... um, never mind. ;)

Tim,

As you stated, Northshore has 3 dealerships, he's relatively new to the bike game from what I understand he's from the automotive side of that house.

LI Yamaha has had dealing with the FJR, I'm pretty sure you'd have a better deal there.

BTW, where's my handguards? :D

"Libel" is a classification of tort known as defamation. Defamation is the wrongful act of injuring another's reputation by publishing (i.e., communicating) a false statement. There can be no libel without a false statement. Truth is a total defense to the cause of action of libel.

If it's true ... it ain't libel!

Report away...

By the way, the Communication Decency Act of 1996 (a federal statute) states that an ISP (Internet service provider) or forum host shall not be treated as the publisher or speaker of information provided by another content provider. In English, this forum will not be considered the one responsible for a tort of libel if a member posts information that is untrue.

That's what I suggested... If the board goes and says Dealer X sucks, there's a problem.

And, 'truth' can be argued as 'opinion', hence 'false statement' by a half way decent mouth piece.

After all, if you pull the race card and the glove don't fit, you must acquit.

I would have thought that saying Dealer X sucks would be an opinion, and count as fair comment?

Or is it the "sucks" that's untrue, therefore wrong, so it would be ok to say "Dealer X is a very bad dealer"?

So am I subject to a libel suit if I say, for instance, that Skoot and TDub have passionate man-love sessions involving le'coque over the phone nightly? Or would I have to post pics and stuff (which I have by the way) or would that then prove the claim and therefore it would be subject to one of those ammendment thingies I hear so much about? Just wunderin'........... :hmmm:

I think to say that (publicly), you might need the piccies, and maybe start running before you sid it :p

Not actually all that clear on where fair comment and just being rude ends, and libel starts TBH.

How about if you called them a couple of figs? :D

That's it, you *******! No more three ways! (By the way, I'll take a set of 8 x 10 glossies...)

Might be a problem to state it factually unless you were actually involved as T-Dub suggests.

However, It is my understanding that if stated as an opinion such as, "I think that they may doin the man love thing cuz I believe that skooters hand was out of sight in what I understood to be . . . . " Well you get the point.

I agree and apolgize for heading off topic with the libel stuff. If folks want to continue to talk about libel and not the issue of this guy's ticker--take it to another thread. You are all well versed in how to use the New Topic button.

Thanks.

Libel talker turned back to Admin.

:rolf: Radman, where DO you find that ****?
If you right click the piccie he posted you'll find it's source to be a site called brandxculture.com This is obviously a site for the, uh, fluffier kind. There. I said it. So sue me you libelous *******s!

Wait... Wasn't this thread about a shity dealer who won't fix a ticker or sumpin'? If true, that dealer sucks!

Sue is on his way over, but I'm not sure you're his type. Let us know.

I'm no *******. My parents were married. Not to each other but they were married. You will have to prove libel.

This thread is about a ******** dealer that wants to charge for a valve adjustment 10 k miles before due on standard service to diagnose a ticker.

Warchild gave the difinitive and I believe the correct advice.

At three dealerships, I knew more about the car I was looking for ('07 Camry) than any of the salesmen we spoke to.
Ahh... the first rule of a used car salesman...

Know how to sell.

Most of them have no clue WHAT they're selling... they could be selling anything.

I've been looking for a pickup truck... been reading a lot on the Camping World Open Road forums... like here, the posters acutally USE their vehicles... hate to say it, but I know more about pickups, engines trannys and vehicle towing capacities than anyone i've talked to at the local dealerships....

But i will admit , not too many people want a 1 ton, 4 door, diesel/6 speed 8 ft bed pickup here where I live...

Tons of 6' beds tho.... but you cant' fit a Harley in the back... not even sure a FJR would fit.... there are times one has to trailer a bike to somewhere else... like when it's snowing! <G>

Thanks guys for hijacking the thread a little bit. I did need a good laugh.

That's why I love this board so much. The humor is just as priceless as the information and knowledge.

Back to the issue at hand.

As we all knew already, The valves were found to be all in spec. (big surprise). Yamaha is covering the repair. Parts are on order and the dealer says that if he gets the parts by midweek it "might" be finished by the end of the week. I'm not going to hold my breath, but if so, that would be nice. I know there has got to be a machine shop involved at some point and I know how they could be at times.

We had a very civil and pleasent conversation on the phone about our feelings on the billing issue for the valve service. As it stands, I am still responsable for only two hours, Yamaha is footing the bill on everything else. He claimed he was going to work with me to get Yamaha to cover the other two, but said it would be best for me to call them again.

I am still going to speak to someone else at the dealer, but I can't get there until Saturday. I will call Yamaha tomorrow.

Warchild, Please don't yell at me for leaving it with them. I know that I should have gotten it back the other morning and went another route. But my job had me traveling out of town this week and most of next week. I just don't have the time to be bouncing around to other dealers.

I understand if things go the wrong way, it's all my fault, and I promice not to burden anyone with my woes.

My fingers are crossed and I refilled my Xanex 'script so hopefully all will be right with the world.

OH-- FJrider1-- Sorry I dissed ya on those hand guards. But I had to give them back to Nick(of FarkleMasters). He wanted to see if they would work on his ST1100. I may see him this week end. If he didn't use them, I'll PM you.

Tim
