Guys,

As many of you following the HID self buy threads know, I had posted about a problem I had with it.

Well, after many phone calls, and emails I have finally found out the real story. I will try to be as concise as possible.

On 10-31 I ordered a set of the Hi/Lo HID lights from Andy. He sent them via Fed-Ex. They delivered them to the wrong address and they turned up missing. On 11-14 Fed-Ex accepted responsibility for them and told me by phone they would credit Andy’s account. They said it would be about 2-3 weeks before he would receive reimbursement.

On 11-30 Fed-Ex confirmed via phone to me that Andy had been credited $295. I immediately emailed Andy and ask him to please credit my Paypal account since he had his funds now from Fed-Ex. Andy emails back that my claim has been denied and the case is closed. I go a little ballistic and email him back with some rather harsh suggestions regarding the situation. I also posted here regarding the problem I was having. After some more emails back and forth between us, I started to question the story Fed-Ex had been giving me. I then ask Fed-Ex to fax me a copy of the documents that would show Andy had received his credit for the lost shipment. This is when I finally get the truth about what has happened with the credit. It turns out ANDY WAS NEVER GIVEN CREDIT FOR THE LOST SHIPMENT! Someone in the claims department had made a mistake and denied the claim. The reason given for the mistake was because I had given Fed-Ex permission to leave shipments at my front door if no one was at home to sign for them and assumed responsibility for delivery at that point. This would have applied to this case except for one small thing. Fed-Ex never delivered it to my door. They dropped it off at someone else’s door and lost the shipment.

This evening Fed-Ex has assured me that they will credit my account directly for the whole amount since they have caused this confusion with their misinformation.

Now, I need to apologize profusely to Andy. He did nothing wrong. I should have not assumed that Fed-Ex was telling me the truth and Andy was not. I should have taken the time to investigate thoroughly before making accusations. For that I again apologize to Andy.

Some of you have emailed me wanting me to let you know how this turned out. I would say, go ahead and order lights. I think we are dealing with an honest person in Andy. My face has the eggs on it in this case.

Actually, your post here does a right fair job about demonstrating the character of a man.

While of course it's "the right thing to do", it nonetheless takes a rather significant set of stones to come clean in the public domain among one's peers.

Unless you left something out then I think you are giving Andy too much credit. He was the one that had a contract with Fed-Ex to deliver your lights and if he knew that you never recieved the lights then it was his responsibility to either refund your money or get off his *** and resolve the issue with Fed-Ex. It sounds like all he did was let you do all the legwork and when Fed-Ex screwed you he then tried to wash his hands of the whole thing. He may not have done anything wrong but he didn't do anything to make things "right" either. You had every right to be upset with him.

Glad to hear it's been straightened out. Kudos for stepping to the plate with the whole story.

Were the fences mended in time to avoid problems with future customer orders for others?

 
I'm proud to be associated with this community. A nice change to the nightly news where much of our society seems to put themselves into a position to be someone's victim or thinks that everyone owes them something.

You are a stand-up dude and should get Andy's name off the super bad-dude list. However, unless I'm missing something, I must agree with MCRIDER007, Andy should have been the #1 guy trying to straighten out the mess. Andy owes you as much or more of an apology than you owe him.

 
John, no added pressure, but......

YOU have been tasked with the responsibility to rebuild American goodwill and moral values (and fair trade practices), overseas!

Keep up your good efforts, eh! ;)

Update on this situation. I just received an email from Andy, wanting me to cancel the claim I filed with Paypal over this mess. I emailed him back immediatly stating that I would cancel my claim the moment I received my money from Fed-Ex. Fed-Ex has promised to reimburse me for the shipment but it has NOT happened yet. These folks I'm talking to there are the same ones that misinformed me before. If I cancel my claim with Paypal, I can not file again for the same incident, so I must keep it active until this gets cleared up. Its my understanding that Andys Paypal account is "frozen" until it gets resolved. Sorry, but I must protect my interest in this mess. Maybe Andy will get involved on his end and help things procede quickly.

+1 You are doing the right thing by letting everyone know how the mixup occurred and I agree with all of the positive comments regarding your character, but you should be getting some help from the shipper because you paid him and he is responsible for your receipt of the merchandise. He should be working with Fed-Ex to straighten this problem out with them.
