I moved and so after moving my former landlord sent a check to my forwarding address, along with a mover's checklist of what needed fixing or not (everything was good to go) with my refund and prorated last month's rent. So I now have this wonderful 800+ dollar check, but I went to deposit it today and realized they didn't sign the front of it.

I called them, and will be waiting for a response tomorrow, and I will email them too so I can have a more "written" documentation that I contacted them. I don't EXPECT them to pull anything shady, but I like to cover my *** with stuff like this just in case. I have the check and have offerred to send it back, shred it, whatever they want, but told them I need a new check, for the same amount, but signed. Sucks that I have to deal with it. Mistakes happen, but man. It's frustrating when I was looking forward to having that little extra to help us move into our first home next month (taking advantage of the first-time buyer tax credit).

Is there anything else I should probably do? Or if I don't get a response or they ignore my calls (I don't think they will, but just in case), is this something you guys think I could fight in court?

Yeah, Sounds like he might be stalling... He might not have the money to pay you and in good faith sent you a check and "forgot" to sign it. I hope he makes it right.

DO NOT SEND THE UNSIGNED CHECK BACK UNTIL YOU GET A PROPER ONE FROM THEM IN YOUR HANDS!!!

It's your proof that they did not pay. You may need to use it as evidence if you have to escalate this to a legal action.

My wife the banker says deposit it, nobody looks at signature lines. It's worked for me with checks from clients. The worst that can happen is the bank will send it back to you.

LDRyder is correct. Deposit the check and be happy. I own a restaurant and deposit unsigned checks every month and have been for 10 years.

The very worst thing that can happen is the bank will not credit the funds and give you the check back.

+2. We get all kinds of checks in my business - not signed - post dated - addressed wrong, etc. The bank deposits every one of them as is. The only issue we ever had was when they couldn't figure out the amount printed. Even then, they called us to look at the account - not the originator of the check.
