Minimum 49cc Registration

Been doing some research on my little Vespa import project, wading through all the legalities at the federal and state levels.

Is anyone aware of a state that starts two-wheeled motorized vehicle registration at a limit other than the 49cc minimum? I've been reading state-by-state on DMV websites and haven't come across any exceptions yet, but thought I'd throw the question out to a larger audience just in case anyone knew of specific exceptions that I might have overlooked.

We're expecting to get our first shipment mid-summer. I can't wait to rip it up on one of those bad boys. :coolsmiley02: At a top speed of 23mph, might even wound a mosquito if I hit one.

Kalifornia requires anyone riding a scoot over 50cc to be licenced MC1, anyone riding under 50cc scoot can ride with class C. If it's street legal and ridden on city streets, it's required to be registered reguardless of displacement. No idea if it drops off under 49cc tho.

MC1 = Motorcycle Endorsement (scoot license)

Class C = Standard car only license.

From one of the forums I belong to in GA, they have a 50cc race and its legal on the street. they posted the info someplace, but 50cc and below did not require registration.

 
IIRC, California has a minimum horsepower and/or minimum speed for the freeways. Local surface streets are probably ridden under the discretion of the "pilot".

Nebraska has the following regs regarding scooters:

·Mopeds with engines of 50 cc or less are not required to be registered and titled. However, if they are operated upon the street, you are required to have a valid NE operator’s license (M endorsement NOT required) and you are required to wear a DOT approved helmet.

·Motor scooters of greater than 5 bhp are required to be registered and titled and are considered to be the same as a motorcycle. An M endorsement is required on your license and a DOT approved helmet must be worn.

For Georgia, OCGA 40-1-1 defines the terms:

(28) "Moped" means a motor driven cycle equipped with two or three wheels, with or without foot pedals to permit muscular propulsion, and an independent power source providing a maximum of two brake horsepower. If a combustion engine is used, the maximum piston or rotor displacement shall be 3.05 cubic inches (50 cubic centimeters) regardless of the number of chambers in such power source. The power source shall be capable of propelling the vehicle, unassisted, at a speed not to exceed 30 miles per hour (48.28 kilometers per hour) on level road surface and shall be equipped with a power drive system that functions directly or automatically only, not requiring clutching or shifting by the operator after the drive system is engaged.

(29) "Motorcycle" means every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor, all-terrain vehicle, and moped.

(30) "Motor driven cycle" means every motorcycle, including every motor scooter, with a motor which produces not to exceed five brake horsepower, every bicycle with a motor attached, and every moped.

...and 40-2-20 provides the exemption from registration for mopeds.
