Can't a bartender be held liable if he serves a person he knows is already drunk and then that person gets into an accident on his way home?

Maybe dealers should be held responsible for selling liter bikes to people they know to be squids who crash on their way home.

I know I know, how do you tell they are squids? Easy. Squids have big eyes and tentacles.

When I was 23, I bought myself a Uni Vega Gran Turismo. Large frame, 21 speed, alpine gear set. As I was leaving thier shop on it, it was so light and nimble, I went down hard in some gravel about ten feet from the back door. My first time on a performance road bike and the difference was incredible. K-mart didn't sell anything like it. I rode a lot in those days, 20 -30 miles a day. I felt pretty stupid walking back in and asking for a wet paper towel to wash the gravel out of my knee. Good thing it wasn't an R1.

 
I wonder what it will sell for? Talk about taking a hit on what the squid paid for the bike, compared to what it is now worth. OUCH!

 
On the Crashed Toys site they have 8 categories, and the motorcycle category has more listings than all the others combined.

Bartenders don't make extra money on repairs when their customer trashes their new ride in the parking lot or on the way home. :glare:

Unless a tiered licensing system is put into place that legally mandates learning on smaller displacement bikes (this is a whole bucket of worms I don't even want to get into right now), there are always going to be people with egos writing checks for big bikes that their skills can't cash, and just as many dealers willing to let them do it for a "low, low" financing charge.

i've never understood the rationale (far from a position of "logic").

the only person liable for what you do is you. heaping responsibility on others is a cop out by those who WANT to be irresponsible. why should a dealership worry about who buys what as long as what they sell is legal? if you think there should be tiered liscencing system, then fight to get one established. as long as there isn't, live/die with the results.

Bounce I agree 100%, unfortunately our whole society is one that refuses to take responsibility for our own actions. Its pitiful. But when you've been sucking on the Gov't *** for 40 years its hard to forage for yourself.

One of the big problems in American is that we have gotten where nobody wants to accept responsiblity for their actions and beyond that, nobody wants to point a finger at somebody and make them own up to being stupid. A perfect example of this was how Hiliary Clinton "mis-spoke" about her recent trip where she claimed to be under sniper fire.

She didnt "mis-spoke", she lied. Claiming to "mis-spoke" is a just a nice way of not accepting responsibility for your actions and somehow we are all starting to buy into this carp. When we screw up and do or say something stupid, we need to just own up to it.

Anyway... If you get drunk at a bar, ride a 200hp motorycle, walk naked with aligators, jump from planes with no chute, etc -- when things go wrong, just own up to your crazyiness and dont blame your problems on the bar tender, the motorcycle salesperson, the zoo keeper, etc.

Remember - guns dont kill people, people kill people with guns. People are the problem, not the guns, not the makers of the gun, not the sellers of the gun, not the makers of the ammo, no the magazines that advertise guns, etc.
