This is SO wrong. A legislator in Virginia gets a law passed increasing ticket costs dramatically. Here's the kicker, he's a senior partner in a law firm that handles traffic violations... guess who'll benefit from this? :angry: Can any Virginians on here confirm this? At least those living in another state, passing through, won't get hit with the ridiculous fines. Anyway... I thought I should post this as a warning to my fellow motorcyclists living in Virginia.

Virginia Introduces $3550 Speeding TicketVirginia legislator introduces new speeding ticket tax that boosts penalties beyond $3550, driving business to his traffic law firm.

Virginia motorists convicted of minor traffic violations will face a new, multi-year tax beginning July 1. Led by state Delegate David B. Albo (R-Springfield), lawmakers slipped a driver responsibility tax into a larger transportation funding bill signed by Governor Tim Kaine (D) in April. Albo, a senior partner in the Albo & Oblon, LLP traffic law firm, can expect to see a significant increase in business as motorists seek to protect their wallet from traffic tickets that come with assessments of up to $3000 in addition to an annual point tax that tops out at $700 a year for as long as the points remain.

"The purpose of the civil remedial fees imposed in this section is to generate revenue," the new law states. (Virginia Code 46.2-206.1)

Driving as little as 15 MPH over the limit on an interstate highway now brings six license demerit points, a fine of up to $2500, up to one year in jail, and a new mandatory $1050 tax. The law also imposes an additional annual fee of up to $100 if a prior conviction leaves the motorist with a balance of eight demerit points, plus $75 for each additional point (up to $700 a year). The conviction in this example remains on the record for five years.

Other six-point convictions include "failing to give a proper signal," "passing a school bus" or "driving with an obstructed view." The same $1050 assessment applies, but the conviction remains on the record for eleven years.

Although the amount of the tax can add up quickly, the law forbids judges from reducing or suspending it in any way. The tax applies only to Virginia residents, so that out-of-state motorists only need to pay the regular ticket amount. Michigan, New Jersey, New York and Texas also impose a somewhat more modest driver responsibility tax which they apply to out-of-state residents.

Myth. It was a bill that failed.

Any legislator can make a bill....but few pass....and even fewer of the extreme ones. Hell, we had one in Washington this year to let dogs in bars.

See HB5304 this Virginia hosted website with summary of bill failing or bill detail showing it's left in committee.

This is also why I hate this divisive political crap on this board. Some people are all ready to assume the man is out to get them, post a Nazi picture, and don't bother to confirm or deny something. What law? What source?

My apologies. I was wrong.

Not that excuses should matter, but at the time my Googling only found the failed bill and obscure references in blogs and nothing that struck me as mainstream....and I clearly didn't find the Hitler thing the remotest bit funny.

I want to correct my mistake at jumping to conclusions. I'm sorry SourthernFJR. You were right, I was wrong. Thread reopened.

I talked to a friend who just moved to VA a few months ago and he was telling me about the new laws. OUCH....don't get caught speeding, not signaling for a lane change or whatever! Something to the tune of a $350 fine and 3 payments of $350 besides!!!! More if they find it necessary. DOUBLE OUCH. The figures may not be correct because my brain went on overload when he started talking that kind of bucks for those fines.

I’ve reconsidered my previous off the cuff statement. This isn’t a bad idea and here’s why. One political party here in VA cut the personal property tax for vehicles (annual, and for me that amounts to around 1k/year or so – they didn’t drop it, only reduced it) so they could get a good campaign slogan and get elected – they did. Off course politicians (this may shock some of you so please sit down before continuing) don’t look beyond their own elections and lo and behold, tax revenue (supposedly for roads, etc) is below what’s “required.” (I hope the previous statement will nicely fit into the “historical fact” category and not be deemed political – that’s how it’s intended) So, if the choice is to raise everyone’s taxes back to the former rate (of course we’d have to add inflation, graft, etc and it would be above the former rate) or, tack on “fines” to “law breakers” and save me from higher taxes; well Sparky, I’ll tip my hat every time I see someone pulled over for a driving violation preparing to provide me with tax relief! If it’s me pulled over, you are most welcome!

Of course we could always work together to figure out an equitable tax system that would allow everyone to pay into the system and only pay for what is actually needed, but I’m pretty sure that boat has left the pier so here we are.

This may have already had an effect. I travel the HOV lanes on 95N during the week. I’m one of those schmucks who either ride in a carpool or ride my bike and am legal in the HOV. Traffic is generally backed up in HOV lanes at various points because it’s full of the “self-important” who don’t believe the HOV rules apply to them. You know folks, the people in BMWs, Mercedes, pickup trucks, and SUVs who are a law unto themselves because they, well because they drive BMWs, Mercedes, pickup trucks, SUVs and are apparently a “special” class of citizen deserving special privileges unavailable to the average smuck law-abiding citizen. Well, yesterday and today (new fines took effect on Sunday) traffic in the HOV lanes did not back-up as normal. Either the new fines have the attention of the self-important, or the 4th of July holiday has reduced traffic – time will tell. I suspect the fines will help out for a relatively short period, and then it’ll be business as usual. BTW, a State Trooper was pulling people over at the north end of the HOV – that really does warm my heart and thank you lady in the small 4-door sedan riding by yourself in the HOV (yeah, she doesn’t fit the special category)!

That’s my opinion and I’m stickin’ to it.

I simply don't behave well enough to afford being a Virginia resident. I was raised and taught that it is wrong to do things for yourself that have an adverse effect on other people, and that legislature is no substitute for good behaviour.

So you won't catch me riding solo in the HOV lanes, but I would use a few hundred feet to pass some ******* making love to his cell phone and riding the dotted lines. That would get me busted, ticketed, fined, and taxed to the max IF I were a VA resident.

This truly sucks for any VA resident, especially those with bikes.

Oh, and Jim, my HD neighbor commented about how light the traffic was all the way down I-95 for his return trip home yesterday. So sorry man, it's not effects from the new law. He started out in PA and ended in southern NC.

Jeff - you and I were taught the same! You can ride solo in the HOV; on a bike or in a "Hybrid" w/the required license plate.

95 traffic is a truly wonderous and puzzling thing. It all depends on your timing - and there isn't always a rhyme or reason to a good or bad time! I don't think we'll get a true idea whether the new fines are keeping the "special" amongst us out of the HOV until next week when the effects of folks taking off Mon/Tue or Thu/Fri ICW 4 July have passed. It was lighter in the HOV this AM and yesterday AM.

The key to your buddy's comment is what time did he pass thru N VA. Rush hour is between 0430 - 1000 and 1430 - 2000; at any times other than those you have a fair - fair mind you - chance of passing thru in reasonable time. That is of course if they aren't doing roadwork which they habitually do between 1000 and 1430.....

I think that one day soon Lorie and I will join you in the Tarheel state (we lived near you from 88 - 92) but perhaps a bit farther to the west.

Looks like Va has gotten too big for their britches. There are a lot of folks up in arms about this. I'll be curious to see what happens.

I myself signed a petition not too long ago. Unaware if it'll do any good... but it can't hurt.

 
I gots me one of them thar reckless tickets...not sure why? I mean I was (w)reckless, after all. :(

I guess I shouldn't be making light of the getting one, but uh..it's all I can do right now.

 
This is the result of a politician (doesn't matter which party) who cut your taxes so he/she/it could look good at election time. Won the election and now.......guess what, short of tax revenue....hmmmmm, how can we fix this terrible problem....

And welcome to $1000 + tickets!
