Hey Rebel, I work for the state of MS loss control and risk department. I handle all liability claims filed against our state agencies. Also I am a member of STRIMA State Risk and Insurance Managers Assoc. California also has a member. I think the head of their dept is Gary Estrada [sic.] Ralph Mauer used to be but he has now retired, of course they are located in Sacremento. Anyway, what I am trying to get around to saying is that you had inquired about filing a claim against the state of Cal., if they knew about the spill and failed to warn or correct/clean up. The statute laws vary from state to state on this subject, but I would suggest that you call the Cal. loss control and risk dept, ask for Gary, tell him a STRIMA bud suggested you call and inquire. MS law provides that the state must have actual or constructive notice of the hazard and adequate opportunity to protect of warn against. Those issues would fall on both the highway dept and the MHP.
