It was a good thing that I had already slowed down earlier. Perhaps the ticket somehow saved me from a potential problem on my ride in to the office.

Yer doesn't supposed tuh be adoin' thet stuff. Ouch-a-ma-gouch...that'll hurt your wallet. This bike gets to high speeds and feels so good riding there that its sometimes a real awakening to look down at the speedowmeter....OMG! However, I doubt that will be a good defense.

Did he know it was your b-day? Did he say anything to that effect? Was it POP radar? POP radar is defensible. I cannot imagine that he paced you? More details might help the forum to come up with some defenses. In any event, try to enjoy your special day.

Ewwwwww, at all costs, you must resist the temptation to take us down another radar/LIDAR defense road...this forum has tried that several times and it gets ugly sometimes.

Sorry, 'bro, this is just not going to be good for ya. And I'm thinking Mr. Insurance Agent is going to be none too pleased when this hits your driving record.

Towards that end, I'd be looking at retaining a killer lawyer specializing in these things, and see if he can work whatever deal can be worked (if any) with the Prosecuting Attorney to get it reduced somehow. Otherwise, the fine is just the beginning of the payments you're going to be making.... :(

I should mention that the officer (who was on a bike) did mention that he was doing me the favor of writing the posted speed as 65 instead of 60, so that may help a little. He also wasn't too pleased with my stereo headphones but didn't write me up for that either. I simply asked... "if you can show any leniency, I would really appreciate it, but if you can't...of course I understand".

The speed trap was very far in front of me when they zapped me and i pulled over as soon as I saw that it was a trap which was simultaneous to them waiving me over. In the past officers have appreciated me pulling over very quickly (sometimes even before they did).

Pawtracks Good to hear from you. I was actually getting on it pretty hard earlier 100+ but started thinking about Tripletango’s post ( Deer strike ) and that memorable image at the very end and actually remember slowing into the 80’s prior to being stopped. I didn’t argue my speed though.

I didn’t let it ruin my day and tried to view it as Luke said, perhaps he was doing me a favor. There were people that were very upset when they didn’t make it into work for various reasons on Sept. 11th. So you just never know. Maybe I avoided something yesterday or maybe I will be forced to go slower in the future for fear of more of the same and ultimately avoid something bad.

I am going to go to court right away (even before my date, which is allowable) and hopefully the judge will allow traffic school. For those of you out of state, in CA you may sometimes get a ticket off your record my attending traffic school (either in-person or online).

Last summer was my first season on my FJR. I have never had a bike before that was so capable of reaching high speeds so easily. I have found myself, many times, reaching triple digits when passing others, with out even trying. If I had gotten caught on radar, during those times, they probably would have just hauled me away. It is post like yours that keep me thinking and hopefully help me develop more self-control before it is my turn to make a similar post. Thanks for being brave enough to share your story.

If you have a fairly clean record it sounds like you deserve a break. Hope it works out for you. Getting A LAWYER (even to plead guilty) WILL HELP it to work out better for you. They scratch each other's backs, dontchaknow?

+3...Get A Lawyer! If you are into "Reckless driving" territory, there will be no school. Don't trust that you will "look cool and responsible" to the judge. He'she has sen the ticket.

That speed trap was placed there for 3 reasons: Because there has been a lot of activity complained about; To make examples of those scofflaws; To collect revenue from those who get caught.

Let a lawyer plead your case. They can usually get it reduced and THAT'S what you want.

+4 on the lawyer. A good friend got nailed by an airplane, and was getting real close to getting a good record. He hired an attorney and they subpoened every one they could think of, the officer the instructor who certified him to use radar. The state employee who calibrates the radar. Only the officer showed up in court and the judge dismissed. He did spend 500 dollars to get out of a 200 dollar ticket, but no points on his record. saved in the long run.

If you are going start throwing terms around, you should know what you are talking about.

"A "speed trap" is ... a particular section of a highway measured as to distance and with boundaries marked, designated, or otherwise determined in order that the speed of a vehicle may be calculated by securing the time it takes the vehicle to travel the known distance."

Taken right from the California Vehicle code.

I think you should fight the ticket, get the nice policeman some O.T. (3 hr min @ $75 to $85/hr) after all he gave you several breaks, cost the taxpayers extra money and pay a good liar....ooppss lawyer....btw its called "lane sharing" in case you get a ticket for that later.

 
Every time one of these threads comes up, I always see people say, "Get an attorney." I have never understood that. Granted, I only have experience in about 6 court jurisdictions, but in my 18 years as a cop, I have yet to see an attorney do anything of significant value for a simple traffic ticket.

For crimes, absolutely, no question about it, the right attorney can make all the difference in the world. But, he was given a speeding ticket, not charged with reckless driving. Remember, a speeding ticket in most jurisdictions is only a violation, which is a pecuniary offense, meaning the only punishment is monetary, with the possibility of license suspension. There is no jail time possible with a violation.

Oh, and for those of you that suggest hiring a lawyer so you can subpoena the entire world. You better hope it works because the court (judge) doesn't take too kindly to a person that ties up valuable court time by going on a fishing expedition. If the lawyer (or you) does some research and learn that the officer wasn't properly trained in the use of whatever device, then by all means, go for it, the officer shouldn't have been using it in the first place. But every time I have had one of those cases (usually it's when the lawyer himself gets the ticket), the judge is very rigid, and not accommodating. But then, in my case, I was appropriately certified, did use the device properly, and had all the necessary records to prove the case.

Granted, I'm spoiled in that the agency I work for now, as well as most of the surrounding agencies, have a pretty good track record for professional behavior, especially in making sure that certifications are maintained, etc. Other areas may be what's feeding the storm of "get an attorney", I don't know.
