Take my advice: DON'T PAY 'EM FOR THE NEW TIRES!

Kind of a PITA, but I like the outcome. Especially as long as YOUR insurance company doesn't count it as a claim on your history. (More advice: I'd make sure they don't IIWY.) Any farkles mounted you could transfer over to the '13?

I would say that this dealership got off way too easy. Yeah, their insurance rates may go up a little, which they will no doubt pass along to their patrons in increased or padded labor rates, but they screwed the pooch big time here and are walking away relatively unscathed. Meanwhile, although you did get a new bike in the deal, you ended up having to pay the difference between the insurance value and new purchase price out of your pocket. A more equitable solution would have been for the bike shop to have bought you a new bike with no cash outlay on your part.

Either way, I would never show my face in that shop again.

As for the insurance claim, this will be a comprehensive claim, not a collision. That classification reduces the insurance company's ability to up your rates since there is no "fault" involved or established. Even if there was, it would clearly be the fault of the shop. This was true when a deer jumped out in front of my bike, which is also considered a comprehensive type of claim. Although it does show as a "claim" in my history with Progressive, but no negative points were awarded and rates stayed the same.

Strangely enough, the way it fell from the lift,I was able to save almost all of my add-ons. My cal-sci shield was shattered, but most of the rest I saved. My corban rear seat has a tiny scuff, but not even really notable. The front seat was fine, sliders good, exhaust good...heck,I even took my battery tender cable. My grip buddies didn't fair too well either, but no big deal there.

$10,700 for your old 07? Sounds like you made out ok and beats the $6000. the dealer may have offered you on a trade deal.
I hope they treated you fairly on the purchase price of the 2013. Sounds like you made out ok.

WOW! Fred, we sure have some different perspectives.

I thought SuperFLY made out OK getting $10,700 for the old bike and keeping all his accessories.

I do think the dealer should bear some of the financial burden and sell the 2013 for slightly below cost and not attempt to try to make money on the deal. I also think they should offer to move or install accessories on the new bike to alleviate any inconvenience incurred.

But **** happens! They have to make it right and attempt to alleviate any financial burden but I don’t think they have make it the winning numbers in a lottery.

You are correct, they should have to make it right. I don't see where the OP should have had to spend a dime out of his own pocket in that process.

The difference between the $10.7k insurance allowance and a new bike (at the dealers cost) is pretty minimal. It isn't about winning the lottery, its about getting back to where he was before hand.

**** does happen. And when you are in business you are responsible for any of that **** that happens on your watch.
