The cops REALLY need to do a better job - crossing the line for no reason (and killing and maiming people in the process) only warrants a charge of 'driving over the center line'.

How about; Driving without due care; Driving at an excessive rate of speed (faster than grandma could control); Driving in a manner resulting in death; Unsafe driving (for grandmna, that would be at any rate faster than parked); Driving while impaired (her age was the cause of the impairments, not alcohol, presuming she didn't just fall asleep (which is more likely - and I know, because my 90 year old father is still driving, with the full permission and after testing by the local authorities - and HE falls asleep at lightrs and such), but that doesn't make her any better a driver) and from there the state charges her with manslaughter.

However, had the riders run a speed cam at 2 over, you can be certain thay they'd have been ticketed and fined $135 each in the name of 'safety'.

It's insane how tickets are issued and $$ values are assigned to violations. If you get your picture taken on the freeway going over the speed limit here in AZ it costs almost $200.

I don't advocate the death penalty for a person causing an accident, but for pete's sake there has to be a better way. You can kill someone and there is no penalty. I guess being a little old lady has it's advantages. If a teenager chirps the tires at a stop light he at least gets a reckless driving citation. I don't know the answer I guess, but my blood boils everytime a see a story like this. :(

 
Killed in the crash was Sheri Leidholt, 30, of Devils Lake, N.D. Her husband, James Leidholt, 37, who was driving the motorcycle they were on, was hospitalized and has since been discharged. They were married four days before the crash.
Geez.... 4 days! Can it get any more ****** up than that?! :angry2:

Actually it doesn't COST anything - from what I've read you can ignore AZ automatic tickets with impunity.

 
In the article it quotes the highway patrol captain as saying the charges were appropriate, they investigated thoroughly, and without negligence they couldn't put through any more serious charge.

Well, what the **** do you call it when someone drives into oncoming traffic??!?!?!! Is that not negligence??!?!?! And when negligence results in death and injury . . . . .

Absolutely tragic and disgusting.

I understand she's old and all, but... Shouldn't involuntary manslaughter be at a minimum? I bet if she ran over a dog, PETA et al would have her thrown away for some time.

Time for a good personal injury attorney to convince grandma's next of kin that there won't be no more casino money left if she continues driving. :angry:

It's a tragic miscarriage of justice when someone can kill people and they just slap on the wrist. She probably won't lose her license or be tested to see if she is competent to drive.

Then the paper has the ****** nerve to minimize it by saying "her car hit two motorcycles" in their headline, TOTALLY skirting the fact that people were KILLED. :angry2: If they would have said something a little more hard hitting like "92 year old hits 3 motorcyclists, killing one", that might do some good by making other olds farts think twice about driving.

I'm all for having folks re-take tests be keep their license. We can all use a refresher course every now and then, and it would be a good opportunity to cull the heard. I know if i didn't sharpen the saw every few years i wouldn't have as much on the ball. When i think of all the knuckleheads out there driving, without a clue, or a care, because they can it really pisses me off. Don't get me goin...

Since the law prohibiting driving over the line where oncoming traffic has the right of way is for the purpose of promoting safety and avoiding foreseeable injury, the act of driving over the line and doing exactly the mischief the law was enacted to prevent is known as "negligence per se" in most jurisdictions. In other words, you don't even have to address questions of duty, due care, etc. to find that this is negligence (which alternative test this act seems to easily meet, as well).

How does one get to be a highway patrol captain and so cavalierly and ignorantly reach a conclusion so obviously at odds with black letter law in pretty much every jurisdiction in the country?

 
This is ridiculous and insulting, especially to the family of the victim.

If they're going to let this old lady stay on the roads, I think I'll just avoid North Dakota all together...and I'm going to let the Governor know that he won't be seeing any of my tourism dollars (although, really, what the hell is in North Dakota??). It's not much, but I think it's about the extent we can do (if we have any N. Dakota residents, you might have a little more clout):

My father was killed by a truck driver who pulled across the road in front of him; went under the trailer. Highway Patrolman said the charge should have been negligent vehicular homicide. The county prosecutor charged reckless driving, then reduced that in plea bargaining to careless driving, which is the same thing you get charged with when you run over someone's mailbox. Some people just don't give a ****.
