Come about 5:45 this Sun eve I had to run out to get an exhust stud for one of my machines I was working on (new manifold). I pull out of the AutoZone and cross Hwy 31 a divided 4 lane to run up the road to another auto place as this store did not have what I needed.

I cross the S lane to the median and turn N all in one motion. As I pulled from AZ lot I saw a car approaching from 300 or so yards away heading N. The only car in the area No traffic. Anyway I pull out and head N and and am accelerating (not slowly, but leagally) This guy Is traveling faster than I figured 70-75 in a 50 so he closed the gap quicker than expected, BUT he still has a completly free open lane at his disposal so I shouldn't even hamper his fast ass. By the time he actually passes me (in the open lane) I am up to 45-50 and he starts blowing his horn. Then he speeds up, cuts in front of me and stomps his breaks. Here is where I tell you I was (luckily) in my big ass crew cab dually (9500lbs empty) and he is in a newer black Taurus. I did not hit my brakes, I figured if he wanted me to hit him I would oblige his wishes and this big ass truck of mine would stop someplace around the front seat. He speeds back up with fingers out the window etc. I'll be honest, he has raised my IRE and if he wanted to dance I would take the lead. We hit the next light and he pulls into the turn lane and I pull next to him. The lady of the car rolls up her window a I hang out mine staring this punk down. I would guess a 17-19yo wanna be. I tell you If he had offered I would have Schooled him. I know I would be arrested too, but damn, what an ass hat, All I could think of was what if he were doing this with my wife and kids in the other car. The light turned and I went on.

I know get the tag # and report him, hindsight you know.

Something about pricks like that really make me wanna "educate" them

 
Don't know about legal eagles but I always try to evaluate bogeys long enough to accurately estimate their closing rate. What if he was on a bike doing 175? IMO, best to avoid close calls. He might be on meth and in a bad mood with a gat on board. :trinibob:

One LEO's opinion...

Had things gone sideways, it prolly wouldn't have turned out good for you. He clearly was an ass, but if you would have taken a substantial step to continue the encounter, you'd have been in just as deep as dummy was for driving the way he did.

That said, if you had gone the distance with him, I'd have come down to be a character witness for ya at your trial! :p

 
Personally, I will sometimes 'play' with ass hats like this kid, but once I feel myself getting angry I back off and chill out. It's not worth getting myself all fired up over a stupid kid with too much testosterone.

The way this would have worked out (best case scenario):

You get a tag # and a good look at the driver and contact the police.

You make a report and advise the officer that you want to get a warrant.

You do ALL of the work and the magistrate does not give you the warrant.

More than likely, you lose interest before completion.

The police can't really do anything because they did not witness the violation. I'll bet that Alabaster would not even take the report in the first place. It's best to just let the guy know he's a ******** and move on. Happens to me all the time! :p

The way the Kingston, NH cop explained it to me is that the police are obligated to check out phoned in complaints about dangerous actions on public roadways. Based on the credibility of the caller they may issue citations. The person that made the phone call is obligated to meet me in court on the day of my hearing so that I may refute their claims. Again, the outcome will be based on credibility.

All is tru about the cops and the court, but in real life it simply does not work. At least not in my case.

Couple of month back I had an ahole tail gate me badly for about 1/4 mile. I waved he showed the finger. Been MSF instructor and knowing better I sewrved to the media and let him by. 1/4 mile down the road there was a traffic jama nd I snaped picture of his plates with my cell and went directly to the local PD. They gave him a ticket. I showed up in court. Guy admited to tail gating me, and all judge said that it was stupid to tail gate motorcyclist and let him go. I was ready to dice and slice :assassin: I try to protest but the ahole, now the one sitting behind the bench, would not even talk to me. Procecutor tried to reassure me that at least I was not dead. And I said I am so glad until next time he really kills me.

So, it is possible to get people ticketed, and cops are supposed to follow up. But unless you have a judge that is willing to do his job you wont achive anything.

so, can I interest someone in a giant schreder :assassin: j/k

 
I know how this **** makes you feel. I felt it just reading about it. But.................................you must turn and walk from these situation. I trained for 8 years under a 9th degree Korean Grand Master. Always his words were "walk away until it is impossible to walk away".

In automobile situations, I have listened to these words. I will also admit to having to talk myself out of feeling like a punk at times for doing so. That said, my rational brain knows that there is very little chance of much good coming from engaging these mother f-kers. My life goes on as it was before.

If I engaged, and something went very wrong (as it very well might), I know that I would look back and think, "it just wasn't worth it." "What was I thinking?" "How did I let this punk **** with my life like this?"

You ask about hypotheticals so you will never get a true answer cuz each case is different.

If you would have gotten out and schooled him, you'd be in trouble for sure. However, if he got out and approached you, you have the absolute right to defend yourself. Where it gets tricky is who has the more plausible story. Sometimes in cases like this the truth is buried behind consistent lies of the other side. If both male and female say the same thing, that you got out first and attacked, once again, you'd probably be in trouble.

If you are asking about what would have happened if you hit the brakes as he was closing the gap. Again, every circumstance is different. If you were a 75 year old who isn't too competent to begin with behind the wheel, nothing would have happened because a case against you, for the most part, has to have intent. A 75 year old saying, "I got scared seeing that car racing up behind me I just wanted to stop and hope I didn't die" goes a hell of a lot farther than, "I wanted to see how far my rear bumper would go through his windshield"

 
This is a simple case of the lug nut rule.. "He with the most lug nuts wins".

Fencer...not trying to be an ****** with this post, but looking at it from a different angle (as I often do). I truly see your point: Nothing would have been hard about the guy simply changing lanes to let you in and if he did, a polite back and forth wave could have made everyone feel good about the world...but...

Why assume it's okay to take his right of way instead of waiting a few seconds?

It sure would have sucked if something had caught his attention at the wrong time and assuming he had the right of way looked up to see himself slamming into your truck that cut him off.

It would have also sucked if when you glared at him if he stepped out with a M9 and capped you 16 times.

Honestly, I think you may have made moves that assume a lot about the driver of the other car making good, polite choices while paying attention to what's going on. I've done that and have been flipped off before...I deserved it. Other people have done it and got hit by a driver not paying any attention because he felt he had the right of way.

You mis-understand this part I think.

He ran past me, cut in, and jammed on his brakes! I would be the one parking my front in his rear. This thing O mine may have ABS but it don't stop like a feej!

His right of way was not impeeded IMHO, Its not like I pulled out and stopped. and even if I had he STILL had a clear lane. As I said I was up to (or almost) the posted limit of 50 as he passed. He was just excessive in his speed and I guess I brought him down to the speed limit and he got pissed, oh well.

And not to tought how big my **** is, but I am not going to tuck tail and run "just because" someone "might" do something. Hell, I "might" be that "someone" :devil:

As Mogambo stated which is how I was bought up "walk away until it is impossible to walk away".

If you start it, I will not roll over and die, I will do my damndest to finish it.

BTW - I "tend" to "carry" as well, for those "just in case" moments. B)

Well then...as long as you're safe and he only had to slow to the speed limit, or change lanes to miss you then you should have shot him when he flipped you off. Why are you so slow to protect your honor?
