There is currently a loophole in US Federal law which allows group insurance companies to disallow claims if they occurred during participation or use of legal transportation or recreation including motorcycling.

The previously passed HIPAA legislation has established that employers cannot refuse health care coverage to an employee on the basis of their participation in a recognized legal activity (motorcycling, skiing, horseback riding, snowmobiling, etc). However, the loophole is that benefits can be denied for injuries sustained in connection with those very same activities. So, we are guaranteed the right to health care coverage in general but not to any benefits in the event of a claim resulting from these activities.

A Bill has recently been introduced in the House (H.R. 1076) attempting to close this loophole through amendment to the prior regulations. Since the Bill has only been introduced, it needs the sponsership and encouragement of as many Reps possible in order to debated, voted on, and have any chance of passing.

You can also go to the AMA's Rapid Response website (link below) to get an easy way to contact your Federal legislator even if you are unsure who your representative is. You do not need to be an AMA member to use this website.

I am not looking for debate on this issue here, merely pointing out something that should be of concern to all of us as active motorcyclists. I have used the AMA website to alert my House Rep as to my feelings, and already received a response back from her.

 
Message sent to rep. I'm also quite impressed with how easy the AMA "rapidresponse" website works. It's super easy. All people interested in preserving their livelihood after a motorcycle accident with a health claim... take note and contact your rep.

+1, if you're reading this, you ride, and if you ride, you should go to the RapidResponse site and contact your rep.

This particular element of HIPAA needs to be corrected. I'd hate to go down, and get injured, only to find out I'm not covered. FYI, even if your insurance company says 'your covered' they can still deny your claim and you then have to fight it.

Not if you think the AMA has lost it's way and become a compromising suit and soulless lobbying problem....they don't speak for me. I'll choose my support for that particular bill my own way. However, I digress and not something I would debate in this thread.

This really has nothing at all to do with the AMA or if it knows its way.

As I stated clearly at the onset, you can use the AMA web site as an easy way to send the message to your representative without any commitment, membership or alliance on your part. You can love the AMA or hate the AMA and still use that web site. The default message sent from the AMA website to your representative does not even make mention that it was sent via the AMA. You can also edit the message and send your own version from that web site.

Or, you could just contact your representative directly yourself.
