Gives me the stones to fight the Gift Certificate I got going to look at the Zuke, 86 in a 60 lowered to 79 in a 60 to "reduce the fine". If the cop lowers the speed written, does it follow he has no proof of the original speed suggested? I wonder how that works, or if indeed he has any speed at all.
First and foremost...it varies by state. In WA....I doubt the argument that a cop gave a break and wrote lower is going to pass the snicker test of a judge as evidence they didn't know how fast you were going. Sorry Radman.

However, the only way to find out for sure is to actually "contest" the ticket and pursue "discovery"...or whatever system your state uses. WA has an actual, formal set of statewide rules for traffic courts for average Joe's to become experts in. I bet Warchild will concur it was extra work....but worth the effort having that 10 pages or so of evidence to puruse before the hearing.

I'm still toying with the idea of putting up some FAQ's about speeding tickets (by state). I'm looking for non-quackish "subject matter experts" in each state to consider drafting. I've drafted something for WA and got some interest for OR......and maybe CA reading this threa...but nothing in LA.

I intended to go to court on it in any case-if nothing else to get one of those "no tickets in a year and it goes away" type of deals. In any case, I'm not too upset about it, he missed giving me the other 437 tickets I qualified-sometimes heavily-for.

the last one i had was none in 90 days... within the city limits of where it was issued!

BAM! that was easy. i stayed out of that town for 90 days! :rofl:

 
I don't know how it is in other states, just Virginia and Oregon, but reducing the speed of a ticket will not increase your chances of a dismissal because the lower speed is known as a "lesser, included charge". In other words, if you were going 80, legally, 79 is a smaller part of 80, and thus, is a lesser, included charge.
