Not to be too hard on the judge, but a $2,500 bond? :angry: . A guy up here in Brown County (Green Bay) hit two people, killing one, while drunk and his bond is $100,000. A couple of teenagers and a lady kidnapped the grandmother...didn't even hurt her...and their bonds are all between $75,000 and $125,000. Kill a motorcyclist...bond is cheap. :angry:

According to the charge, Schehr told the deputy she was operating an Audi at the time of the crash. She told the deputy she had fallen asleep and struck the motorcyclist.

One might assume that miss Audi driver can afford a good attorney.....

Bail, be it bond or cash, is not an indicator of guilt or severity of the crime charged. It is a component in a court's decision as to the likelihood that this person will return to court. The sole purpose of bail is to secure the defendant's appearance in the future. If a defendant has "roots" in the community (owns a home for a long period, is employed in the community, has kids in the schools) and has no record, bail will be less than someone who lives outside the jurisdiction with spotty employment and a prior criminal history.

This may have been also taken into consideration when they set the bond amount.

The next step is an arraignment, on Tues. SEP 04 at 8:30am. If you're able to attend,

PLEASE do. We had about 20 people last time she was supposed to appear...

but didn't. Her lawyer called in about an hour before to say she was waiving her

preliminary hearing!

According to the DA, who's been involved in the area for 15 years, there's only been

1 person similarly charged (killed someone by DUI) who did any jail time, and

he was from out of state.

The potential penalty for this level of felony is 25 years in prison, $100,000 fine, and

loss of driving license for 5 years. The DA is fully expecting the judge to give this

woman probation for the DUI killing of Dan Christ.

If that makes you mad, write to the DA, write to the judge, write to the local papers.

Write _polite_ but passionate letters, insisting that this killer spend time in prison!

The judge is: Dan Klossner (same address) The clerk's office says he's on medical

leave until after Labor Day.

The deputy clerk of court who is handling this case is: Dawn Luck (same address)

I almost posted up earlier, that she wouldn't appear due to a postponement, or they would waive the prelim (bad idea in my mind as they get to see most of the cards on the table from the prosecutor) and hoped I was wrong. I was right, so I will make this prediction:

No prelim probably means a deal has already been cut, or will be. There may be an arraignment with only the lawyer present, but there won't be any trial.

Call me a cynic.

Sorry for the loss of the biker, it never should have happened. Firdt I am not taking sides just want to giveyou a different perspective if they do not give her jail time.

Every time a death occurs involving a motorcyclist we all want a stiffer penalty because hey get off with a pretty lite sentence. Instead of jail time that is a no win situation for both parties. why not have her pay her time by the following:

If the rider has a family she needs to become an extended part of that family and take the role as the person that was killed. be obligatedfor all his duties . take the kids to there sports activities, help them with school, work around the house, prepare dinner and eat wiith them, in other words be a father replacement. Put her on probation for 10 years. when you do creative sentencing like this to good people with an I do not care attitude you will see that person change and become a better person and really understand what she did.

Her sitting in a jail serves no purpose, and the judge alrerady knows this and will let her walk with a min. fine ..

This is what I would present to the judge and let hil think about it..

Jus a different take I hope that other ideas will be created from this approach and then we will see sme results with a postive impact. Jail is not for all. good luck

Maybe I'm missing the point but why would the children of the man killed want the person who killed him taking them to sporting events and helping with the homework? :blink:

BTW, prison time serves the purpose of socially acceptable retribution for the aggrieved family.

If the court lets her off with a minimal sentence such as probation, they are sending a message that penalties such as those listed above will not be enforced. This basically tells people that killing someone as a drunk driver (biker or not) is an OK thing to do - nothing really bad will happen if you are caught. I'm not saying she has to go to jail for 25 years. I'm saying the court should have fixed penalties for crimes, with minimal if any ability for the judge to control the penalty level. Choose an appropriate penalty level for a crime and stick to it. Otherwise don't keep the law on the books.

People commit crimes because they think they can get away with it, or that the penalty will be minimal if they are caught. Like it or not, if you want to reduce incidence of a crime, you have to put some "teeth" in the penalties.

This was just to offer a different wat to look at it if she was to get off almost scott free and only a small fine.

Hopefully what you try to accomplice here is to re-educate and and retrain their way of thinking and knowledge about motor cyclist and what the greiving family goes through. Than you have another person that is an advocate for motorcyclist.

I do not agree that Jail is always the best punishment. I do like the comments just give it a chance. Remember she would be part of the grieving family and share in that also..

If some one has another approach, I would like for them offer up their idea for more ways than just jail for the truly good citizen thanks
