Yikes!! At least you have all Winter to get well and heal the bike. :dribble: I'm sorry to hear of and see the incident.

BTW, that WAS a fire on road to Ice House not clear-cutting.

 
I am going to ask the obvious question because as to how the police (chp ) reacted to the accident.
And that would be, did the chp site the at fault driver yet or is it still being investigated by them.

Just curious as to how they come to the conclusion as who was negilect in this incident..

From reading BBIII (got it rite this time Andrew ) report I think she should get ticketed.

BBIII you will be healed in no time and on the road again take care.

No tickets, so far. The ER staff had just given me a 2nd dose of Dilaudid (SP?) it is a very stong narcotic) and in walks the very nice and polite Investigating CHP officer Werner on Saturday at about 6:00 PM. He asked me If I had been drinking to which I paused enjoying the rush from the Dilaudid (SP?), and then I replyed NO, I have not been drinking today. Then he asked me to look at his face and follow his finger, Smartass me asked what do you want me to do, look at your face or watch you finger :dribble: ? I told my story to him and when the questioning was done I asked and he said "the cause is still under investigation".

My Knee is still recovering. I go back to work on Thursday 11/23/2006. It was Good timing to have all this time off, just before I crashed. I only missed 4 night shifts.

My wife & I agree that I'm done with motorcycles after I sell all my stuff. (cheaper to keep her)

Anyone want a "slightly" used helmet? Actually didn't the NTSB or some entity want helmets from MC crashes for some study or is that over?

 
BBIII helments are one crash than through away, to much chance for failure.

No matter how much you paid for the helment or what others might say, helments are one timers.

Fight the ticket you crossed for safety that is a bullshit excuse from the chp and the easy way out for him.

Sorry to see you leave motorcycling but you got to do what a man has to do.

Have you penciled that out yet? ;) Hate to lose ya BBIII, your sense of humor will be missed on the rides. Get that S2000 and you can play hyper-roach-couch on our rides through the twisties B)

Thanks D, I'm done with the MC thing @ 49 years old, Done. The Wife who went from 320 lbs to 160 lbs and with the the new $16K tummy tuck/ boob job/ etc agrees that I'm done with motorcycles also, so we can be together AKA - lots of sex. After 26 years I can't afford to **** this up. I'm looking at the Honda S2000 and other sports cars hit so I can ride as a support vehicle for FJR adventures :)

Not everyone can trade the FJR in for sex. B) First the FJR saved your marriage, now it's being traded in for something beyond valuation. If you want that S2000 to keep up with FJR's, you better get some good tires on that sucka :assassin:

 
I'm going to miss you, Bill. No question on your decision, you keep the most important things and hold them close.

I believe I'd appear before the judge regarding the ticket. Get the pictures that were taken at the scene and present your case to the judge. At least you get to explain your actions and that you were trying to avoid and avert when the car pulled into your path without warning or signal and struck you as you were passing.

You might ask a local lawyer who frequents this site. :rolleyes:

Enjoy your life, friend. Uhm, you could meet us for lunch (or pre-ride breakfast).......wherever we might stop.

I'll echo Mike's thoughts on fighting it. That cop had his mind made up and was definitely bike-unfriendly when I got to the scene. And shit! -- he didn't even see it!

When you get the notice from the court, one of the choices is to fight it via trial by declaration. You have what I would think is a reasonably good chance of getting that ticket tossed by the judge. The facts, as you related them, seem a whole lot more credible to me than the cop's version. You know how to get hold of me, so if you want some help in requesting the trial by declaration and doing the declaration, let me know.

In the declaration, you should note that the cop wasn't a witness and even that the officer tried to administer FSTs while you were in the hospital just after the docs medicated you heavily for pain. (Of course, it'd be a lot more fun in a trial (not via declaration) to get him to commit on the stand to his version and then ask him about specifics in what he actually saw to back up that pipe dream he wrote down.) Seriously, though, in a trial by declaration, there's a good chance the cop won't respond with a declaration (to adequately do it on this ticket via what is essentially BS accident reconstruction would be pretty time consuming), so you may get a notice of your acquittal a couple weeks after you submit your declaration as a result of his failing to submit a declaration.

Thanks Rich, I'll think about the TBD. I'm feeling much better now that I'm back to work and have to concentrate on something other than knee pain.
