Hmmmm. How to respond......\

OK....

1. It was my bike that was crashed. I had it less than 48 hours. The bike had 2000 miles on it, was PRISTINE and I waited approx 3 months for the bike in order for the customers Triumph 800 Tiger came in.

2. Not a newbie. 45 years riding experience. 40 years of allowing people to ride my bike. Everyone that ever damaged one of my rides always stepped up to the plate and took care of the damage. Not Brian Church, an exec at QVC. After calls to see how he was doing and also to see if he wanted to handle this outside of the insurance company, not one call from him. At that point I didn't know that in Ca, the bike is insured, NOT the rider.

3. We had discussed his riding abilities. His TWO Fjr's he owns. He got to 3rd gear (audible) then claimed he didn't know what happened. NO cars or obsticles on a 3 lane (each side) road. Where he GRABBED the lever controlling dual radial mount Brembos, unless he was way over the limit (50), there was NO reason to brake.

4. Over $7000 in damage to a bike I needed to do my 130/day commute on and I am still waiting for parts and repair. I've been told July sometime.

5. The actual repair is about $8300 but because I didn't want the bike totalled, I settled for partial repair.

6. I get a letter from my insurance saying the claim is 100% rider error and will be refused! After a little digging, this turns out to be a copy of a response letter from insurance to Mr. Church....He wanted them to buy him a new Arai!!!!!! Unbelievable.

This guy knows about my $500.00 deductable and has made no effort to pay or assist. I was out of work for 2 years and took this job at around 60% less. The out of work situation has ruined my credit and now I'm making the 21% interest bike payments while not having the bike.

7. I found out from this from the guy that Mr. Church got a ride to the airport from the hospital from. We agreed that motorcyclists do not do this to each other. He couldn't believe the guy that had a job such as Mr. Church does would do this as well as ask for a ride on a forum to save $30 on a taxi.

Yeah, I learned an expensive lesson. But the worst part is feeling betrayed by a fellow rider.

Any suggestions on this situation/FJRs owner?

I was talking with some friends about this when the thread first started and we agreed he must have been riding like a total asshole/idiot to do this. And that is something you just don't do when trying somebody else's ride. Sounds like Big-B is not only a douchebag, but was trying to do a stoppie.

Unfortunately, I don't have any solutions for you.

On a side note, I would recommend NEVER financing anything at 21%. It can wait.

I haven't been asked as of yet from someone to ride my faithfull steed. When I do I am pretty sure what the answer will be.

I can appreciate your frustration and feeling you have been betrayed by a fellow rider but the best thing you can do at this point is to move on...and be thankful that you are not being sued by some third party that could have been involved in the accident. Loaning your bike to anyone is always a risk, and if you loan it you better be insured with high liability coverage and be prepared to pay any deductibles out of your pocket. As you said, its been an expensive lesson and should give all of us something to think about before we hand the keys to someone for a test ride.

+1, Gunny to both 03silverbullet and to SkooterG. Steve is one of the most trustworthy and dependable FJR riders I have ever met, if that is 03silverbullet's judgement: Then that is the truth! SkootyG and I spoke to each other on the phone within hours of reading this, when it was first posted onto our FJR Forum. Between us we have many thousands of miles and years into motorcycle riding, our very first response to each other was that Big-B was pulling a stoppie and couldn't pull it off! Sorry, Jeff!

Amazing. What a turnaround. I haven't seen this thread in some time, but here it was in "new posts," so I clicked to see how "poor" Big-B was doing. I started by re-reading post #1 so I'd remember the situation. It was funny, because for the first time, I notice his whole post was about him and his injuries, getting stuck in CA, etc., but not a word about the bike or the poor guy who generously loaned it out to him. No concern?

Like most of you all, I've had nothing but great experiences with forum members, sales to and from them, personal meetings and everything else. I wasn't one of the many who got burned in the famous group buy fiasco that never did get made right. Sorry to see it looks like another burn. I hope you have some kind of legal recourse, MJeff. Too bad it had to come to that.

First of all, I feel very bad that this unfortunate accident had to happen to you and with your recent tough times.

#6- Who is your insurance company?

This is not engraved in STONE. Call your Insurance Agent and see if they can intercede for you. Not All Insurance Companies are Created the Same.

Also, contact Mr. Church's Insurance and see if his Insurance will cover most of your losses.

Before you try to stoke up a personal firestorm prematurely, please attempt to pursue the above mentioned actions and I hope it works out for you with a speedy return to your repaired cycle...it hurts.

I've never met the guy or talked to him before but I did help him route his ride he took on the rentals. Kinda pisses me off now knowing he could screw over a fellow biker and still sleep at night :banghead:

I will say this -

 

Crashee - pay the owner of the bike.

 

*You* were piloting the ride when *your* actions put you into the situation of a broken femur and trashed motobike.

 

Own up for your actions.
