Highway Peg Scraping question

I have touched the regular pegs before the brackets, with the highway pegs folded.
I don't think the highway pegs will move up if they touch. They hinge straight up, while the regular pegs pivot up and back. Actually, having lowsided with the pegs down, I can tell you for a fact that they don't fold on touching down, they bend themselves back, or bend the mounting bracket back, or some combination.

There was one rider (can't be bothered to do a search) a couple or three years ago who crashed, and blamed the crash squarely on the peg post.
I'm not the rider who crashed because of these. As a matter of fact, I didn't touch them down while riding. I once dropped the bike that had been moving fairly slowly & hit the hinge which caused the peg to torque the bracket & allowed oil to leak from the engine cover. Make no mistakes folks. The brackets for the pegs are mounted to ENGINE COVERS. It doesn't take a rocket scientist to realize what a bad thing this could be. The next day they were off the bike. I remember more than one rider going down because of scraping these things.

 
Heidi and I don't have a lot in common; however, my highway pegs also caused an engine cover leak.

I'm not sure what caused it. Like I said, I was scraping the right side mounting pivot regularly. It was ground down pretty good when I took it off. Then, on a trip home from South Carolina, I hit a huge road gator right outside Nashville. It hit the bottom of my bike and bottom of my right foot. My foot was numb for almost an hour.

My highway peg had been down and I was pretty sure that gator hit that, preventing further damage to my foot. The next day, after I got home, I found oil leaking from the right side cover. When I removed the bolts, they were bent to Hell. The "C" shaped bracket was also bent, and that had to be from the gator.

Not sure if the grinding of the mount led to the bent bolts, or if it was the gator hit, but timing and common sense point to the gator.

I took the highway pegs off and replaced the gasket on that side. With the OEM bolts back in the holes that were thankfully undamaged, I have never seen another leak. I decided then I would forego any increased comfort for the preservation of my machine. Haven't missed them really anyway.
