Thanks Bounce for the info. I knew that info. But alot of other people don't.

25 mph? No its like 100 + on freeways of Dallas/Fortworth. And "Five lane" shifting cutting you off in your lane.

Other things the A-holes like doing is slaming on there brakes to get you to rear end them.

I even had one that pulled into my lane and out of his sunroof at 70 mph toss a just open can of Coke.

He was atempting to hit my windshield. Hmm can you say ROAD RAGE?

I followed that a-hole for miles hoping he would exit freeway and park it.

Ah I just wanted to talk to him? Ask him if he knew Jesus.

 
Bounce.....that's one of the things I got ticketed for....riding on the side...when I was on me harley. Copper didn't care bout the scoot overheating. Just asked me if I had taken a course for bad driving in the past year...which I had...for a speeding ticket. He said...."well, good luck".

Just woundering if as you were driving 25mph or less? What lane? Right side curb with Emg-Flashers on?

You know if it was me I would have made sure I had the jack ass Name & Badge number. Then call 911 ask for another officer to show up; Other one is your witness to the fact you are Not in violation of the law.

This would have ben a SAFTY thing. Meaning you where atempting to make it to the first off ramp befor your bike broke down. And not only putting you in danger. But others allso if they hit your bike. Being on the side of the freeway is not safe. Hell all troopers know that.

Just get all names & badges,note time of day, location, weather conditions,ect. Point is you want detailed FACTS. Just acept the Ticket from Mr. jack ass.

And when you get home file your complaint with certified letter; One copy to the D.A.,another to Internal Afairs Div.

Cops don't like being investigated by Internal Afairs. Even if they are in the clear. There is aways a record of them being investigated. And it could keep them from being promoted in the future.

I know Letters work. I have my own story to tell. Point is if you Know your within the law.

Don't just let some jerk cop get away with it. Fight back with the POWER of the pen.

Be real carefull pulling that stuff in Texas (ie, argueing, telling him he's wrong, or calling for another officer to come out) moving violations in Texas are Class C, and an officer can make an arrest for Class C, with the exception of normal speeding, and one other, but can not remember what it is. You might win in the long run by getting out of it, but there is the strong possibility of going to jail in Texas when you piss off an officer on the side of the road. In Texas, it is the officers discreation to issue a citation or make an arrest. BTW, I'm not a police officer, but do know about this.

I did not say to argue with a cop. You get no where doing that.

But you have every right to explain in a calm voice why your driving on the side of the roadway with your flashers on.

And you have every right to reqest another cop to witness what was said. And that you were atemping to drive to the next exit. To safely get your self and your bike off the road.

Cop has every right to give you a ticket.

And 911 operator has every right to tell you they can't dispatch another cop to your location,since there busy.

You have every right to deal with it in court. And wright letters ect.

Arrest?

Has to be other facts involved befor a cop would arrest someone.

Hey most cops try to help someone out. But sometimes you run into Mr Cop Intimidater.

Abusing peoples rights. Thats one of the reason they have a Internal Afairs Dept. and a DA to contact.

 
There is one other state I found that it is ok to lane split, Montana.

The AMA keeps tabs on all state laws pertaining to bikes.

I really dont know how much splitting you can do there as there are few cars and lots of two lane roads.
(I previewed my post before putting it up and there must be code embedded in the link I copied that caused the whole thing to be underlined. Since I can't get it out, I'll just apologize for it now. And here's my comment:)

Don't you believe it. Here's the quote from your own link: "Riding on motorcycles. (6) No more than two motorcycles may be operated side by side in a single traffic lane. (7) All motor vehicles, including motorcycles and quadricycles, are entitled to the full use of a traffic lane, and a vehicle may not be driven or operated in a manner that deprives any other vehicle of the full use of a traffic lane, except that motorcycles may, with the consent of both drivers, be operated no more than two abreast in a single traffic lane."

That ain't what we call lane splitting here in California. That MT law (in section 6) is ONLY saying two MOTORCYCLES can ride side by side in the same lane, and then only with the consent of both riders. So you could even be ticketed for passing another bike in the same lane under that law. Section 7 specifically prohibits you from moving into any lane that already is occupied by another vehicle (he is entitled to full use of the lane). And of course finishes by repeating what was already laid out in section 6 about two MOTORCYCLES side by side in a single lane. And not a good idea either.

There are some things not to love about Cali, but being the sole state where it is not prohibited to move through a traffic jam (and that's one of the things not to love here), aka lane splitting, sometimes called lane sharing here in the forum by others, is one of the best.

(And by the way, having just come back from Montana, don't feel bad. 75 mph limits, wide open roads, gorgeous scenery, and NO SALES TAX!)

If your passing in the same lane. You would have to wait for the other guy to pull over to the right."slower move to right".

Then do your pass. Example Farm tractor?
