This is Madjackdog1's wive. He made it to the very last of his 3000 mile trip when he was hit from behind by a jerk on a cell phone! It's a miracle that he is alive! He is surgery for a broken back. He has two broken hands and broken left foot as well. Excuse if I posted in wrong spot. He thinks highly of all of you and I promised to post message. Please direct all of your positive thoughts towards the Kern Medical center here in Bakersfield ! They are AWESOME

And, Mrs. Mad....by all means see an attorney sooner than later. You'll want to have the cell records as a matter of record. This wasn't an "accident"....it's unlawful to talk on a hand held cell phone in CA, this was an "incident" that a careless (obviously care-less because the perpetrator decided everyone's safety wasn't as important as their privilege.)

The District Attorney may decide to not prosecute this to any meaningful form of justice or punishment. That leaves the responsibility for redistribution of the perpetrator's assets. At least to the masimum of their and your insurance (assuming you have underinsured motorist coverage).
