+1/GunnyHey War Machine - I don't recall seeing your name on the list for permission to crash. You do know you're supposed to do that right? (and permission is always denied).
Glad you're more or less OK. Was the old guy insured? It seems pretty cut and dried that he hit you from behind, so is at fault. If he has decent insurance, I believe (and don't quote me on this) that pain and suffering is often assessed at three times the material damage.

I have to concur. I'm really glad you weren't hurt any worse than you were. But I gotta tell you, I would never ride, let alone commute, on a motorcycle in the greater NYC area. Hell, I don't even like to drive a car in there. I mean, isn't that why they have buses, trains and subways?oh war machine! i have worried/wondered about you since last year when you joined. i know your big city is way bigger than mine but i also know its just a matter of time, as commuters, before we are taken out. i'm so glad yours only included minor injuries. its what i pray for when its my turn. hope you heal up quickly and that new black 08 is gonna be here very soon for you!

Believe me, I never trust someone waving me on that it's OK. After all this is NYC. Some people hate bikes so much they will wave you on into the path of a tractor trailer! From the limited sight beyond the mini-van all looked clear, but obviously wasn't. But then again the old man that hit me went around the merging mini-van...where the hell was he looking before he rear-ended me?From your description, I get the impression that you didn't see what was coming in the lane you were about to merge into.Did you trust the waving minivan driver to check the lane for you?
