Here is the update. My daughter drove me to the police dept to pick up the accident report. She got a 'verbal warning' :dribble:

The bottom line is it doesn't really matter whether she was arrested or not. She admitted to the cop that she hit me, she thought I was moving. Yeah, there is a lot of rightious indignation that something more should have been done. I don't know if she was on her cell (it is against the law here in Connecticut). Her insurance company is on the hook and that's all that matters to me. I'm sure that if she killed me the police would have taken more interest in the accident :glare:

I'm ok, more or less, and the bike has about $2300 damage. I contacted her insurance company and an adjuster is supposed to call me today. The service manager of the shop wants me to drop off the jacket & helmet this AM. He is pretty sure they will pay for both of them as part of the bike damage. The total towing (2X) is almost $500.

Depending on how long it takes for the parts to come in and me coming off the percoset I hope I don't miss too much riding this summer!

I lost a co-worker a few months ago 'cause a 'bitch' was texting on her cell phone. She blew through the intersection at 75 mph (speed limit was 45 mph), no braking, and T-boned my co-worker in the driver's side door. He died on scene. Cell phones and vehicles don't mix! I'm glad that you're okay.

If they are on the phone and not paying attention, there is really not much you can do apart from wearing bright clothing and or helmet. Many times when I look to see someone approaching me from behind at a light I will make some movements to make sure they see me. Arm stretches, twisting around, getting off the bike and doing cart wheels, whatever. Something to jar them out of whatever stupor they are in so they notice me. My Scorpion glow in the dark helmet looks a little corny, but I really do not care if it gets someones attention.

I'm glad your ok for the most part, my biggest fear at a signal is being hit from behind, I was rearended 2 yrs ago on the Freeway. I now keep an eye on my mirrors till the car behind me is stoped and when they are approaching I'm blinking my brake lights to get there attention. The insurance company should pay for all your riding gear at full retail + tax. Have your shop go over your bike with a fine tooth comb.

To the OP, glad you're ok, but if it were me, I'd petition to the local police and/or DA and demand something more than a "verbal warning"
