No, just apply the DUI laws to it, 6mo loss of license on the first offense, AND enforce it!

The damage to your bike will prove that your version of the story was correct.

Once that's done, if I was in your position I would ask the prosecutor to make examples of these liars so that others would think twice before lying to the police about the circumstances of an accident.

Damn, dude! Glad you weren't seriously hurt! That coulda been waaaay worse, of course! Scary ****, for sure! Good on ya for having good gear and at least trying to cover your six.

 
What a ******. I hope they throw the book at her. Good thing she's not a congressman, they just get a slap on the wrist for killing bikers.

Heal up quick and don't take any more percocets than you have to or you'll need some ex-lax before too long!

 
Glad you are relatively OK. Make sure you include all of your gear and clothes in the claim.
I wonder if the witness who said you just went down on your own was the same person who actually hit you. I can't see why anyone else who was there would have made that up. And how could she have not seen you? Cell phone? Other distraction?


Geezer, my thoughts exactly. She needs to be charged with making false statements, obstruction of justice, etc. Wow! Glad they caught the *****, and glad you're not more seriously hurt. Prepare to do battle with the insurance companies, but be stalwart and, as Hank Stamper said in "Sometimes a Great Notion," "Don't give a inch."

Here is the update. My daughter drove me to the police dept to pick up the accident report. She got a 'verbal warning' :dribble:

The bottom line is it doesn't really matter whether she was arrested or not. She admitted to the cop that she hit me, she thought I was moving. Yeah, there is a lot of rightious indignation that something more should have been done. I don't know if she was on her cell (it is against the law here in Connecticut). Her insurance company is on the hook and that's all that matters to me. I'm sure that if she killed me the police would have taken more interest in the accident :glare:

I'm ok, more or less, and the bike has about $2300 damage. I contacted her insurance company and an adjuster is supposed to call me today. The service manager of the shop wants me to drop off the jacket & helmet this AM. He is pretty sure they will pay for both of them as part of the bike damage. The total towing (2X) is almost $500.

Depending on how long it takes for the parts to come in and me coming off the percoset I hope I don't miss too much riding this summer!

I lost a co-worker a few months ago 'cause a '*****' was texting on her cell phone. She blew through the intersection at 75 mph (speed limit was 45 mph), no braking, and T-boned my co-worker in the driver's side door. He died on scene. Cell phones and vehicles don't mix! I'm glad that you're okay.

If they are on the phone and not paying attention, there is really not much you can do apart from wearing bright clothing and or helmet. Many times when I look to see someone approaching me from behind at a light I will make some movements to make sure they see me. Arm stretches, twisting around, getting off the bike and doing cart wheels, whatever. Something to jar them out of whatever stupor they are in so they notice me. My Scorpion glow in the dark helmet looks a little corny, but I really do not care if it gets someones attention.

You're a more tolerant man than me.. What about lying to police officer? That should be enough. Good karma will find it's way back to you - perhaps another 90 years of accident free riding?

I'm glad your ok for the most part, my biggest fear at a signal is being hit from behind, I was rearended 2 yrs ago on the Freeway. I now keep an eye on my mirrors till the car behind me is stoped and when they are approaching I'm blinking my brake lights to get there attention. The insurance company should pay for all your riding gear at full retail + tax. Have your shop go over your bike with a fine tooth comb.

To the OP, glad you're ok, but if it were me, I'd petition to the local police and/or DA and demand something more than a "verbal warning"
