As to the most important point; My prayers and best wishes to Carl for a Full and Speedy Recovery.

As to the less significant point; a frozen Tach means zilch in an accident. That electrical instrument could have ended up on any number during a catastrophic failure. And yes there are LEO's that are prejudiced against Bikes. During one(of many) pull-overs the Deputy informed me that HE thought Bikes "should have seat belts". I chuckled the rest of the day on that one. Obviously, NOT A BIKER!

Hope everything turns out well insurance or court wise as well.

I go on vacation for a cpl weeks and come home to this. Hoping for a speedy recovery. I'm sure we will find a way to get you to the next PNW Tech Meet, wouldnt be the same w/o you. Best wishes to you Carl.

From some text messages received last night around 21:34 Central time:

"Okay so carl made it out of his second surgery fine. He is heading to postoperative right now. The dicit (?) said that the chips of bone weren't as bad as they looked on the x rays. They were please with the outcome and he is recovering well from the original surgery. They removed the suction wound vac from the incision from the first surgery and it is looking good. They said that it is going to be a long time for the recovery process. At least 3 months before they can let him start to put weight on it."

As I told some of you guys, my mom wrote a letter that she asked me to post for her. If you knew my mom, you would know that her and computers don’t mix. Lol So here it is, exactly like she wrote it.

FJR FORUM:

To all of you of the Motorcycle Riding Family who were well-wishers and supporters for my son, Carl Goleman, and his super-duper wife, Jonnie. Carl Suffered some serious injuries in his motorcycle- to-car crash on Monday, July 27, 2009. Some of you know him, and some of you do not. But this grateful thank you and gratitude goes out to all of you, however, just doesn’t seem to be enough. But it comes from our hearts, I.e. Carl’s family and friends. Your responses were very touching and emotional, and we will never forget you. Words for encouragement for Carl, really hit home for me, as well.

Also, please keep this in mind. We feel alot of Carl’s survival contributes to the fact he was wearing much of the essential protective gear for motorcycle riding: full-face helmet, gloves, and a motorcycle riding jacket. I know fashion and looks are Cool, but making it out alive after meeting “Mr. Crash” is even more Cool. I hope you all stay safe as you venture out for other wonderful rides on your bikes.

Last but NOT least, it enlightens me to know there really and truly are wonderful people in the word, Right Now.

Thank you all, so very much.

Ok guys, I got some updates.

Yesterday I finally had court for my ticket. As I told twistedcricket a few minutes ago while we were messaging, all in all it went better then it could have. Among other things that were said, the officer originally tried saying I was doing 60 to 70 mph in a 25 mph zone. Ya, B.S. and at court changed it to 36 mph.

All fine and dandy, but……… I have some mixed feelings. I hired a lawyer and as we all know, (Hudson, close your ears and cover your eyes for this next part) those dirty basterds are not cheap. I ended up doing pretty much everything i.e. measurements of the scene with pics photos of tires to show they were not bad like the officer had said and I also did all the math on gear ratios and fps (feet per second) to show that there was not a chance for me to have been going the speeds the officer said I was.

So we get to the court house and are waiting when the officer asked to speak with my lawyer out in the hall. Before the officer says anything my lawyer says, “we are not pleading guilty, we have plenty of evidence on of our own.” The officer says “ok, well I had a accident scene analysis done and it shows that Carl was doing maybe 36 mph.” My Lawyer comes back and tells me this. So I’m thinking that with the paper work that would have been done for an accident scene analysis, there would be no way of fighting that. So we go up in front of the judge and the officer says that after he wrote the original report he went back and with math refigured the speed at 36 mph. Wait a minute didn’t he just tell my lawyer that he had it done by some else? After all this, I ask my lawyer to talk to the cop about getting a copy of the Accident Scene Analysis. The officer then tells him that he had a friend of his that does that sort of thing to actually do it for him and 36 mph is what he came up with and that no paperwork was done. Story keeps changing. So the judge drops it to me doing 36 mph and that also gets rid of the reckless driving charge. Now I pay some money and go to a “High Risk Driving Class” If I would have known, and had my Lawyer been on the ball, that he had no supporting evidence for this, I bet that I would have had it dropped.

So now I am left with paying about $170 for the ticket and class and the money to the Lawyer, when it would have been dropped. Furthermore, to find out, the officer only looked into it more when he found out that I had a lawyer, instead of doing his job in the first place. Also know when I go after the insurance company the told me to “f” off because they said I was doing 60 +, I may only get like half because they will probably say that I was 50% at fault. And if thing would have gone the way they really should have, I would have no ticket and a higher chance of getting something, anything from the insurance company, after my $83,000 hospital stay and all the money lost from not being able to work and loss of bike and ……….. Need I say more?

Sigh………

Thanks for the update Carl. Obviously things could have turned out better in court...hindsight is always 20-20. Keep the healing going and make another run at the Insurance company, you never know what will come of it.

Good luck

Alfred

That sucks big time. A bit off on the speed Officer? It makes you wonder about their accident scene investegator

Maybe a new lawyer and an appeal? It may seem like good money after bad, but if you could get the ticket thrown out altogether, could this maker a huge difference in the insurance settlement? I'm no lawyer, but it seems that finding out after-the-fact that the officer had no documentation to support his "analysis" might be grounds for appeal - wait, it wasn't his analysis, so whose was it? Is that "analyst" any kind of expert? This thing sure got sideways on ya. Sorry, Carl.

For those of you who know Carl (n2osx) this os his wife Jonnie. Carl got in an accident on the way to work this morning. A car pulled out in front of him and he couldn't stop in time. He hit the car and was thrown over the top to fly about 45 feet. He is up at the hospital in trauma unit. He has a dislocated femur and a pelvic fracture. He also has a fracture in his lower spine but we haven't gotten much information about that yet. He can move everything but is in a lot of pain. I know his friends on the forum mean alot to him and wanted to let you know how he is doing. I haven't seen the bike yet. But it didn't sound so good. I'll let you all know as things progress and new information as it comes in.
I feel his and your pain. When I was 21 years old ; had a woman cop pull out in front of me . Doing 60 on my Yamaha 360 Dule purpose. I had 35 feet to stop ; and I did when I hit her. Lot of stuff broken ; but thank goodness I was wearing a Helmet. Am 60 now and still have back trouble from it.

My thoughts are with you and praying for the best. When he get well ; make sure that the Insurance pay well ; because more than likley ; things will pop up ; cause by the accident.

Get Well Carl

Jim
