2. Not a newbie. 45 years riding experience. 40 years of allowing people to ride my bike. Everyone that ever damaged one of my rides always stepped up to the plate and took care of the damage. Not Brian Church, an exec at QVC. After calls to see how he was doing and also to see if he wanted to handle this outside of the insurance company, not one call from him. At that point I didn't know that in Ca, the bike is insured, NOT the rider.
What a terrible situation. I reckon really not for most to comment on, but there is some jacked up stuff going on here. I am sorry for your situation,

however if I had been burned more than once by someone wrecking my ride; step up and fix or not, it would be a discontinued practice,

especially someone you don't know. Especially on a bike that doesn't have a clear title.

That being said, there should be some communication from Big-B to resolve the issue.

30 days is plenty of time to negotiate injuries and start making things right. Why I still encourage his speedy recovery,

I encourage him further to contact you with a sensible of resolution. For not only does he stain his own name and reputation, this has now

carried over into the FJR Forum, and he will be referred to by you within your years of telling this story as the FJR owner who crashed

your new bike; fled the city and made no effort to take responsibility.

6. I get a letter from my insurance saying the claim is 100% rider error and will be refused! After a little digging, this turns out to be a copy of a response letter from insurance to Mr. Church....He wanted them to buy him a new Arai!!!!!! Unbelievable.
I haven't let anyone ride my bike, and I hold the title. I would entertain the thought, but being somewhat a skeptic,

that person would have had to known me for a while, and I know his character and financial situation concerning paying for any damage.

I will for certain contact my insurance agent and ask these questions. I thought that a rider's insurance would cover them riding any

bike; such as car insurance covers rental cars. Curious to ask my agent. Question, isn't most 90% of all motorcycle accidents are

rider's error? I know the LEO's write you a ticket for it, so I really don't understand why your insurance company just walks away

and don't cover anything.

Does that mean if you did it, they wouldn't cover it either? Very interested in that one.

As much as it pains you to endure this unfortunate event, maintain your character and dignity and take the high road.

You have been much more patient than I would be. I would have already paid him a personal visit and had the conversation

in person; not to engage in any confrontations, but just to gauge his intentions and know up front what I am going to have

deal with. Sounds as though you may have something for an attorney to chew on. Be blessed in your efforts.

Well, gotta go finish packing for the family week on the water.

What an absolute *********! BigB's not a motorcyclist; he's just a self absorbed ********* who can afford to buy motorcycles. Sounds like he can't ride for **** either.

Wow! Just "wow" I don't know what else to say..... How about, I hope everyone gets what they deserve. (Which seems pretty clear after reading this thread.)

Crashee - pay the owner of the bike.

 

*You* were piloting the ride when *your* actions put you into the situation of a broken femur and trashed motobike.

 

Own up for your actions.

Bro' Michael, very interesting point you made that Big-B has a history of crashing motorcycles and playing games with insurance companies. Real name: Brian Church.

First of all, I feel very bad that this unfortunate accident had to happen to you and with your recent tough times.

#6- Who is your insurance company?

This is not engraved in STONE. Call your Insurance Agent and see if they can intercede for you. Not All Insurance Companies are Created the Same.

Also, contact Mr. Church's Insurance and see if his Insurance will cover most of your losses.

Before you try to stoke up a personal firestorm prematurely, please attempt to pursue the above mentioned actions and I hope it works out for you with a speedy return to your repaired cycle...it hurts.
According to my insurance company to whom I provided Mr. Church's insurance info, In Cali the BIKE IS INSURED, not the rider. i'm sure that they would/will go after formost insurance if they can. This is not a personal firestorm. I am more than capable of doing that but choose the high road in this instance. I am hoping that Mr. Church, his fellow employees that ride and his friends will do the right thing after this. However from the "me, me, me" of his posts, I am sure that he will go to another forum or just change his name. Sad.
 
The reply that had the legal advice was deleted much to my dismay. It was a comment by a nor cal rider. I read it and was going to thank you for the effort involved to type that much info (for me at least!) but then couldn't. Thanks for the great advice!!!!!

That looks like some very good advice and Rich is a stand up guy too.

Just finished reading all of this and am really sorry to see this happen to you, Jeff, and that the other party is as stand up as Rich and most of the members of this board. I will think bad thoughts about his physical manhood... I am headed for New Orleans tomorrow so maybe a voodoo doll and a couple of pins may be worthy of a purchase while I'm there. :D

 
WOW ! This has gotten ugly.

I haven't followed this for a while so I didn't know what was going on.

I met Brian at Wheaton camp out last year, and he seemed like a good guy. I was sorry to hear about the whole thing.

I hope Brian heals up OK, and I hope he makes it wright with Jeff, because it's the wright thing to do.

This is the reason I never want to ride anyone else's bike, although I have offered mine to good friends to try. I think I'll be rethinking this.

I don't want to sling mud. I just hope It all works out.

When I was a young lad I spent every dollar I had, at the expense of eating, to create the finest Yamaha TT500 in existence. This bike was my life.

Job offer for South Korea - big money, accepted, 2 months.

So called 'friend' says "Let me keep that high strung TT of yours operational", and I agreed.

Phone call at 0'dark thirty - the bike has been totaled and rider is in hospital, major injuries.

He ran into the only power pole in a 10 acre patch - drugs, alcohol, etc impaired.

Rider survives.

Motobike owner doesn't see one freaking USA cent compensation.

I am still pissed at that ******* and if I ever see him again will forthright instill Creston Militia judgment upon him.

One of my co-workers was a MC passenger as a kid (he's ~55 now), he and his buddy were hit by a local driver (drunk & fighting with his girlfriend). My friend woke up in a hospital missing a leg from the knee down. We were talking at work the other day and he said he bumped into the driver of the car a a local business. I wondered how he kept from passing out a little 2x4 justice. I'm afraid I'd have told the driver long ago to never be in the same building as me unless he wanted a tub handlin'. I don't think I could ever get over such a wrong.

This thread has taken a not so good a turn, but it could have been prevented with a single sentence from a stand up guy.

"Dude, sorry I trashed your bike, don't worry about a thing, just send me the bill."

 
This whole thing is getting out of hand. This is why we have insurance. If they both had insurance and they exchanged info then I don't see the problem. The insurance companies will take care of it, and if they don't , that's why there is court.

The inconvenience of both parties will be a lesson learned, because they are both at fault. I think both have to man up, and move on.
